The lawsuit filed against Premcor Refining Group, incorporated in Greenwich, Conn., seeks penalties in excess of $25,000, saying the company violated the Bureau of Underground Storage Tank Regulation (BUSTR) rules.
Among the violations, the lawsuit alleges Premcor failed [image-nocss] to conduct site assessments or submit reports after closing underground storage tanks on two occasions, the newspaper reported.
The allegations concern Clark gas stations that operated in Elyria, Vermilion and North Ridgeville, Ohio.
An attorney from the company's law firm of Vorys, Sater, Seymour and Pease was unavailable for comment Monday on the lawsuit, according to the report.
The lawsuit states that the company received numerous extensions of time to comply with BUSTR rules and was in violation of Ohio law for extended periods. An evaluation of the Elyria site was submitted in 2005, 1,312 days after it was due, according to the report.
Under the law, the company is subject to a civil penalty of up to $10,000 a day, according to the lawsuit.
