Premcor Settles UST Violations

Consent orders cover tanks at 55 former stations in 26 Ohio counties
COLUMBUS, Ohio -- A Texas oil refining company accused of illegally releasing petroleum from 45 underground storage tanks in 26 Ohio counties will pay $4 million in penalties and clean up the former Clark gas station sites, Ohio Attorney General Richard Cordray and Ohio Department of Commerce Director Kimberly Zurz said.

The Premcor Refining Group Inc., based in San Antonio, Texas, has agreed to 26 separate consent orders filed in the counties where petroleum had been released. This agreement will result in the cleanup of 55 former gas station sites in Ohio and the payment [image-nocss] of $4 million in civil penalties.

Premcor owned and operated various Clark gas stations throughout Ohio, where petroleum was illegally released and not properly examined for its environmental impact. Many of the sites have already been or are in the process of being inspected for further action.

The agreement orders Premcor to pay $3,000 per county for enforcement costs, a total of $78,000 for 26 counties, in addition to the $4 million in civil penalties.

The Ohio Attorney General's Office pursued legal action against Premcor on behalf of the Division of State Fire Marshal Bureau of Underground Storage Tank Regulations (BUSTR), which is part of the Ohio Department of Commerce.

"Through strict enforcement and legal action, we have reached an historic agreement that holds Premcor accountable to the citizens of Ohio and ensures that all 55 sites are remediated," said Zurz.

The consent orders are being filed in the following counties: Allen, Ashtabula, Butler, Clermont, Columbiana, Crawford, Cuyahoga, Delaware, Franklin, Hamilton, Knox, Lorain, Lucas, Marion, Medina, Montgomery, Portage, Richland, Seneca, Shelby, Stark, Summit, Union, Van Wert, Wayne, and Wood.

The orders are being filed separately in each county because the Ohio statute that governs underground storage tanks in Ohio requires that actions be brought in the county where each underground storage tank system at issue is located.
