Kevin Kasselder, owner of We Martin Bartlett, and Roger Baumgart, owner of RB's Food Shop in Humphrey, settled civil complaints filed against them by the Nebraska Attorney General's Office this month in Lancaster County District Court by offering their voluntary compliance with state law.
The AG's office alleged that between [image-nocss] Jan. 1, 2006, and May 9, 2008, Kasselder bought fuel containing ethanol and sold it in We Mart's regular gasoline pumps at a higher price without informing customers.
Baumgart was alleged to have committed the same violation from Oct. 1, 2007, to April 24, 2008, according to the report.
Neither assurance to comply with state law "should be considered an admission of statutory violation for any purpose," the court documents said.
According to the court documents, Kasselder agreed to donate $5,000 to charity in Bartlett.
Baumgart agreed to make a $2,000 donation to charity in Humphrey, as well as pay $1,000 to the AG's office for the cost of the investigation and attorney fees, the report added.
Neither agreement prevents anyone who believes they were the victim of a gasoline blend scam from seeking "any and all available legal remedies," according to court documents, the newspaper said.
