NACS Comments to DEA on Combat Meth Act

Insufficient compliance time, group says

ALEXANDRIA, Va. -- The National Association of Convenience Stores (NACS) has submitted comments to the U.S. Drug Enforcement Agency (DEA) in response to the Interim Final RuleRetail Sales of Scheduled Listed Chemical Products; Self-Certification of Regulated Sellers of Scheduled Listed Chemical Products. The comments relate to issues raised about the compressed timeline to comply with the Combat Meth Act.

According to the NACS website, the association is specifically concerned about the short time frame given to retailers to comply with the act. NACS [image-nocss] said there is not sufficient time for retailers to fully comply with the training and logbook requirements.

NACS members want clarity and reasonableness above all else from this rulemaking process so that they can fully comply with the law when selling cold medicine, the comments said. NACS is concerned that the current rule places undue burdens on its members, particularly small-business retailers. NACS is concerned that the DEA failed to consider small-business owners and convenience store retailers in particular when it drafted and published the interim final rule.

The NACS comments concluded by asking that the administration suspend enforcement of those provisions until new crafted rules have been promulgated.

In other NACS news, the association has formed an alliance with marketing information provider ACNielsen to provide analysis of U.S. and international convenience and petroleum marketing sales data.

The end-result of this effort will be several new and expanded industry initiatives and educational activities designed to assist convenience and petroleum retailers to increase their opportunities for growth and profitability. Among the new deliverables will be a convergence of industry data sources to NACS category definitions and enhanced NACS State of the Industry reports.

While the agreement applies to ACNielsen U.S., it will align with other NACS initiatives currently under way in Europe, Asia, Latin America and Africa.
