Sheetz Resumes Takeout Beer Sales With Appeal

But distributors group hopes court says no

HARRISBURG, Pa. -- The Pennsylvania Liquor Control Board (PLCB) has appealed a court decision hat halted takeout beer sales at a Sheetz Inc. convenience store in Altoona, Pa., and the store resumed beer sales yesterday, reported The Philadelphia Inquirer.

According to the Associated Press,PLCB spokesperson Dawn Petrosky said it wants the state Supreme Court to review the Commonwealth Court decision, which said Sheetz's beer-sales license required the company to allow beer to be consumed at the walled-off restaurant in the c-store building. Sheetz [image-nocss] had recently begun selling beer for takeout only.

"We've been without sales for a few days, and I can tell you that based on the sales before the suspension, our customers really like the convenience," Sheetz vice president and general counsel Mike Cortez told AP. "So I can only assume that they're going to be happy that the sales have resumed."

Bob Hoffman, a lawyer for the Malt Beverage Distributors Association of Pennsylvania, which sued to challenge the Sheetz license, said it plans to ask the state Supreme Court to keep the lower-court order in place while the PLCB appeals.
