Opinion: Convenience must act immediately to save Illinois’ hemp beverage market

Legislature poised to add a behind-the-counter mandate with just hours left in the session

It's never pleasant to receive an "Urgent Action Needed" email on a Friday night.

Unfortunately, for those of us working in regulated industries, it's becoming a familiar occurrence.

I received one such email from Diana Eberlein, chair of the Coalition for Adult Beverage Alternatives (CABA), last night. The issue? A set of last-minute provisions the Illinois legislature appears poised to pass that could effectively cripple one of the nation's most successful hemp beverage markets.

Here's what retailers need to know: if HB5784 HAM1 becomes law, all hemp beverages will be required to move behind the counter beginning November 12, 2026, regardless of whether federal law changes before then.

For many operators, that's simply not feasible—at least not at the scale hemp beverages are currently selling from coolers, beer caves and floor displays.

The result could be devastating for a category that has become an increasingly important source of traffic, sales and profit for convenience retailers.

"This will reduce sales to a fraction of what they are today and cap the market's potential," Eberlein said. "Our customers are the voice Springfield hasn't heard yet, and a flood of constituent emails in the final days of session is what moves votes."

What makes this situation particularly frustrating is the timeline. This language was only shared publicly on May 29, 2026. Yet the Illinois legislature is expected to pass it before the session concludes tomorrow, May 31.

In other words, the clock is ticking.

As an industry, we need to act immediately.

The ask is simple: make sure Springfield hears directly from the customers, retailers and operators who will be affected.

For those outside Illinois, share this information with colleagues, customers and industry contacts who are in the state.

And for those who have spent years building relationships with Illinois regulators and legislators, now is the time to use them. Pick up the phone. Send the email. Explain exactly how this proposal will affect your business, your employees and your customers.

We've seen this playbook before. Last-minute restrictions. Limited industry input. Rushed votes.

But we've also seen what happens when convenience retailers organize, speak up and make their voices heard.

The industry still has a window to act.
