Utah city sues Top Stop over leak

GUNNISON, Utah -- The city of Gunnison, Utah, along with two of its businesses and nearly four dozen residents, filed suit in 6th District Court in Sanpete County Wednesday against Top Stop Convenience Stores over gasoline that allegedly leaked from a downtown location last summer, reported The Salt Lake Tribune.

The lawsuit says the company tried to hide the 20,000-gallon leak rather than report it promptly, as required by law. By doing so, Top Stop and associated companies added to the community's injuries, the suit contends.

It also claims that the company is negligent, liable [image-nocss] for actual and punitive damages and responsible for the emotional distress caused by the leak, among other injuries. The suit seeks an unspecified sum.

Wind River Petroleum, the Salt Lake City-based parent company for the Top Stop stores, did not respond to Tribune's requests for comment on the suit.
Meanwhile, a contractor for the company, under the supervision of the state Division of Environmental Remediation & Response, continued to blow fumes out of nine homes affected by the spill, said the report. In addition, the company has installed six special pumps to draw the gasoline out of the contaminated ground.
