Sheetz Returns Beer

Pulls brew from shelves to avoid expiration

ALTOONA, Pa. -- Sheetz Inc. removed about 130 varieties of beer from the coolers of its Altoona, Pa., convenience restaurant, on Tuesday, reported The Altoona Mirror.

The beer has a short shelf life, and we decided to send it back to the distributors to sell before it expired, Monica Jones, Sheetz spokesperson, told the newspaper. Stan [Sheetz, president and CEO] made it clear that we don't expect a decision for at least six months; there is not likely to be a quick turnaround. We can't sell beer without a license.

The Pennsylvania [image-nocss] Liquor Control Board (PLCB) has asked the Supreme Court to order a stay on a recent Commonwealth Court decision that stopped Sheetz from selling alcohol at the store. The stay would allow the store to resume selling malt beverages until the Supreme Court makes a final decision on the case, which has Sheetz and the Malt Beverage Distributors Association of Pennsylvania split over convenience store beer sales. Sheetz was forced to stop beer sales for a second time April 3 when a Commonwealth Court judge ruled that sales could not continue while an appeal is pending.

The court determined that a beer-sales license required Sheetz to allow beer to be consumed on the premises, something Sheetz does not allow. The PLCB appealed that ruling to the Supreme Court, and Sheetz resumed selling beer in late February while the appeal was pending. The Malt Beverages Distributors Association then asked Commonwealth Court to vacate the stay, which it did, said the report.
